Property Disputes

Despite all the precautions that are taken out on the purchase of property, disputes often arise following acquisition.

Common property disputes include disputes with regard to boundary lines, encroachments by neighbours, flooding (caused by neighbours’ diversion of drains and water courses), sub-standard work by builders.

Occasionally, more unusual problems can arise with regard to the enforcement of easements, covenants and rights of way, all of which affect properties.

Difficulties such as management companies giving consent to issues arising out of Planning Applications also come under the heading of Property Disputes.

For those who are in rented accommodation, issues can arise with regard to housing, both from the tenant’s point of view and from the landlord’s point of view (frequently non-payment of rent and of damage to property).

At Poole Alcock, we are happy to act for the landlord or tenant, builder or purchaser.

Assistance via CLS Funding (Legal Aid) is not normally available for boundary and property disputes. However, it is available in respect of housing disputes and housing disrepair cases, for those wishing to make a claim.
