Professional Negligence Claims
When you instruct a professional (for example a solicitor, surveyor, accountant, veterinary surgeon etc) you expect a certain level of service. You are to pay for their expertise and specialist skill/advice.
In the vast majority of cases, everything will proceed upon a satisfactory basis and you will be satisfied with the work/services provided.
However, in certain cases, there may be times when the work or services do not meet your expectations. There may be issues as to the quality of service, delay, cost etc.
It is important to distinguish between service issues and those matters which may give rise to a claim for professional negligence.
Ordinarily, service issues would be dealt with by either the professional under their complaints handling procedure or ultimately by the regulatory body.
However, in the event that there is an allegation of negligence against the professional, expert legal advice is necessary. Claims of professional negligence are extremely complicated.
It may be that a solicitor, acting on your behalf to claim damages following an accident, has failed to comply with certain court timetables or procedures and as a result, the claim can no longer be progressed or the amount which you recover is less than expected.
It may be that a solicitor whom has acted upon your behalf purchasing a property, failed to advise you on certain matters affecting their property.
It may be that you relied upon a report from a surveyor before purchasing a property, but the report failed to advise, or incorrectly advised, upon the state and condition of the property.
It may be that the accountant has given incorrect advice regarding the preparation of your accounts and calculations of tax liabilities.
