Disputes Between Parties
Following the breakdown of a relationship between partners, disputes often arise regarding the house or other property/assets.
It may be that the house was owned by one party before the relationship started. There may be an issue following the breakdown of the relationship whether or not that party is allowed to retain the house or whether the other party has any claim against it.
It may be that the house was acquired by the parties during the course of their relationship. There could be a dispute as to the terms upon which this house was purchased by the parties and also their interest in it.
It could be that other assets have been acquired during the course of the relationship (for example a second home, savings etc).
In many cases the parties will set out with the best intentions as to how they are going to divide the assets. However, disputes can often arise as to how the assets are to be divided, when, etc.
In such circumstance, it is important for the party to obtain expert independent legal advice.
