Cycling accident case success

01 February 2012

Mr R, from Crewe, was involved in a Road Traffic Accident suffering multiple injuries including a fracture to his hip and injuries to his shoulder and elbow.

He was hit by a motorbike whilst out cycling.  He eventually received the sum of £19,899.41 for his injuries and financial expenses but getting to that point was not easy.

The Defendant’s insurers were unresponsive to begin with, despite the strict timelines set out by the Personal Injury Protocol.  However, we managed to persuade them to admit liability for the accident.  One final issue was in relation to the value of the settlement figure.  The offers being proposed by the Defendant’s insurers were far too low, considering the injuries Mr R had suffered, and we believed that Mr R’s claim was worth a lot more.

Court proceedings were issued in order to claim the sum we believed Mr R was entitled to.  Following this, the Defendant then made the more suitable offer of £19,899.41 in full and final settlement of the claim, which was accepted by Mr R.  Despite the delays, the case did settle successfully, however, it is worthwhile noting that issuing court proceedings could have been avoided had the Defendant’s insurers been more forthcoming.
