Settlements including care home costs

Poole Alcock specialist personal injury team successfully acted for an elderly client suffering with dementia at the time of her accident on 17th February 2009.

She had visited a hospital following a minor fall at home.  Despite this history of falling, unfortunately the hospital did not risk assess her adequately and failed to provide her with a bed with rails.  As a result, she fell out of bed and suffered a fractured neck of femur.  This was operated upon and left her with a 5 inch surgical scar to her left hip and a ½ inch shortening in her left leg.

As a result of this injury, our client was moved into a residential care home, which was accelerated by 2 to 3 years according to the medical expert.  The medical expert indicated that our client could have been cared for by her family in their “granny annexe” for a further 2 to 3 years had she not had the accident.

The claim settled for £105,000.00 which covered our client’s personal injury, the accelerated residential care home costs for 2 to 3 years and a figure to represent the loss of enjoyment of the granny annexe plus extra travel expenses and clothing costs in relation to the accelerated 2 to 3 years to her family.
