The exposure to conditions that have caused the disease may have been many years ago. However, you may still be entitled to pursue a claim.
You may have heard that a claim must be commenced within three years of the date of injury. This is the case with an accident claim. However, in cases of this type where you have an industrial disease then the three year period does not commence until the date you first became aware of your symptoms and the cause of those symptoms. For example, if you were exposed to asbestos whilst an engineer in the 1960's and you have only recently become aware that you have an asbestos related disease then providing that this was in the last three years you will be entitled to pursue a claim.
