Make a Personal Injury Claim - Don't Delay

It is important to investigate the possible claim without delay. This will help secure any evidence that may otherwise be destroyed and because memories do of course fade!

There is a three year limitation period for personal injury claims although for children the three years does not begin until their 18th birthday. Every effort will be made to negotiate a settlement. However, if this is not possible, Court proceedings must be commenced within three years of the date of the accident or a child’s 18th birthday. If this is not done then you will be prevented from pursuing a claim in any event.

If you are suffering from an industrial disease then the three years is from the date that you became aware of each of the following;

  • Symptoms
  • Cause of the symptoms
  • Were the symptoms significant?
  • Identity of the organisation that caused the symptoms

Although a Court does have discretion to allow Court proceedings to be commenced and continue after three years have expired this cannot and must not be relied on.
