Protective will trusts

These are often used by couples seeking to avoid paying care home fees.  They arrange for their house to be owned by the both as “tenants in common”.  This means that their share of the house does not automatically pass to the survivor on the first death.  Instead, under the terms of their will, it is left on trust for their children or other beneficiaries.  The trust allows the survivor to remain in the house during their lifetime but protects the half share of the first to die from being assessed by the Local Authority for care home fees.
