Back to News and EventsToday the Supreme Court ruled that the current regime of Employment Tribunal fees is unlawful and a restriction on potential Claimants’ access to justice.
The ruling follows the government’s recent commitment to reimburse Claimants if the fees were found to be unlawful. It is not yet clear how and when Claimants are likely have monies returned to them, but it has been reported that the pot of fees to be refunded may be in the region of £32 million.
The decision will certainly be welcomed by potential Claimants who may previously have been deterred from bringing an employment claim by fees of up to £1,200. Conversely, the ruling will not be considered good news for employers given the expected increase in the number of claims.
