What is a Lasting Power of Attorney?

The prospect of coping with a disability, failing mental health or the need for nursing home care is a sobering one. It can be a double blow for those who have failed to make their wishes known, or to ensure their finances are in order. Resolving these issues when you are already frail and vulnerable is complex, costly and may involve your relatives making an application to the Court of Protection, if you do not have a Power of Attorney in place.

If you would rather focus upon enjoying life now, with peace of mind from knowing you have made your wishes regarding your personal welfare clear and that your financial affairs are in order, one of the best ways is to prepare a Lasting Power of Attorney. If you have an elderly relative who is beginning to suffer from lack of memory and confusion, it is important to talk to them about making a Lasting Power of Attorney as soon as possible.

A Lasting Power of Attorney is a straightforward legal document authorising someone you trust to make decisions and act on your behalf in the future if you are unable to. For many, the idea of creating a Lasting Power of Attorney is a sensible one. A Lasting Power of Attorney allows you to specify who you would like to manage your financial affairs and decisions relating to your health and well being if you become unable to do this for yourself. Finding the time to make an appointment with a solicitor to provide instructions and then to re-attend at their offices to sign the prepared documentation can be difficult though.
