What is a Lasting Power of Attorney?

The prospect of coping with a disability, failing mental health or the need for nursing home care is a sobering one. It can be a double blow for those who have failed to make their wishes known, or to ensure their finances are in order. Resolving these issues when you are already frail and vulnerable is complex, costly and may involve your relatives making an application to the Court of Protection, if you do not have a Power of Attorney in place.

If you would rather focus upon enjoying life now, with peace of mind from knowing you have made your wishes regarding your personal welfare clear and that your financial affairs are in order, one of the best ways is to prepare a Lasting Power of Attorney. If you have an elderly relative who is beginning to suffer from lack of memory and confusion, it is important to talk to them about making a Lasting Power of Attorney as soon as possible.

A Lasting Power of Attorney is a straightforward legal document authorising someone you trust to make decisions and act on your behalf in the future if you are unable to. The person you choose can be a friend, relative, or trusted advisor such as your solicitor at Poole Alcock. There are two types of Lasting Power of Attorney:

  • property and financial affairs, for setting up payments, handling bank affairs or selling your property, within the scope you have given them; and
  • health and welfare, for your preferences about ongoing medical treatment, or where you live. This only takes effect when you are unable to make decisions for yourself.

The Power of Attorney document also includes safeguards to protect your interests.

What is our Lasting Power of Attorney Preparation Service?

For many, the idea of creating a Lasting Power of Attorney is a sensible one. A Lasting Power of Attorney allows you to specify who you would like to manage your financial affairs and decisions relating to your health and well being if you become unable to do this for yourself. Finding the time to make an appointment with a solicitor to provide instructions and then to re-attend at their offices to sign the prepared documentation can be difficult though. The costs associated with consulting with a Solicitor for this amount of time can also be off-putting.

The LPA Preparation Service:

  • Provide instructions through our online form, meaning you don’t have to leave home
  • We will prepare and draft your Lasting Power of Attorney documentation
  • We will send your LPA to you for signing and if necessary register the signed document once it is returned (£50 plus VAT additional fee for this service if required)

For in-depth advice on Lasting Power of Attorney, please visit the wills and probate section of our website. Please note that the Office of the Public Guardian registration fee of £82 will also apply in all cases where an LPA is sent for registration.

If you are looking for further peace of mind we are also happy to provide you with a telephone consultation at your convenience to explain how the Lasting Power of Attorney can assist you taking into account your personal circumstances:

  • Who should be your attorneys?

  • What decisions can they make on your behalf?
