Finances on Separation

When parties separate they may be able to reach an amicable agreement about the finances of the household and how these should be divided going forward. However, for most this can be the most difficult area to resolve. Our specialist lawyers can provide expert support and advice in order to carry-out initial voluntary disclosure, where both parties exchange financial information to help the parties reach an agreement. We can identify potential gaps in information and advise you on the merits of any offers, based on the information we have at our disposal.

If the parties are able to reach an agreement then our expert solicitors can draft a Consent Order which will formalise the agreement and protect the parties financial position in the future. Without an effective Consent Order any potential financial claims between the parties can remain open, such as claims against inheritance or future windfalls.

If an agreement can still not be reached between the parties then it will be necessary to issue proceedings at court. The exchange of financial information now becomes a formal process within the court arena. We can advise you on the benefits of obtaining pension actuary reports, expert valuations of property or other assets, where to pitch an offer or conversely provide advice on the offers received.

If necessary the case will progress to a final hearing where an order for division of finances will be made. We can ensure that your case is excellently prepared and you are in the best possible position to reach a favourable conclusion.
